Supporting Documents

There are supporting documents that you must file with your variation application. These documents get filed in addition to the documents listed on the 'What You Need to File' page. The forms you need to complete, and file depend on what terms of your previous order you want to vary.

Forms are posted in interactive PDF  format and Word format, where available.

If you are using the interactive PDF forms, be sure to download and save them to your computer to access all the features, including instructions to guide you through what information is required from you. 

 

Parenting:

I want to change parenting arrangements: If you are asking to change anything about parenting arrangements (like decision-making responsibility, parenting time, or moving with a child), you must fill out and file a Parenting Statement Form FD2A  Form FD2A 

I want to change contact time or interaction: If you are asking to change contact time or interaction, you must fill out and file a Statement of Contact Time or Interaction Form FD2B  Form FD2B 

 

Child Support:

I want to change child support: If you are asking to change child support you must file your Statement of Income Form FD3  Form FD3  with all required attachments if you are:

  • paying child support, and are applying to change the support amount

  • looking for the other parent to contribute toward special expenses for the child

  • addressing child support in a shared or split parenting arrangement

  • addressing child support for a child who is 19 years of age or older

If you’re asking to end support for a child over 19, and the other party doesn’t agree, you may have to file your financial information later on. The child over 19 may also have to file their income information.

The attachments to a Statement of Income generally include:

  • Last 3 years’ Income Tax Returns and Notices of Assessment or Re-assessment from the Canada Revenue Agency; and

  • Current income information like:

    • If you are employed: your 2 most recent paystubs

    • If you are unemployed: your 2 most recent benefit statements (for example, from Employment Insurance, Workers’ compensation, medical Insurance, Income Assistance, CPP or other pension information)

    • If you are self-employed: your 3 most recent completed tax returns with attachments, including statement of business activities OR the 3 most recent financial statements of your business or professional practice.

I want to change special expenses: If you want to add to or change the children’s special expenses - like childcare, health expenses, university costs, and extracurricular activities - you must fill out a Statement of Special or Extraordinary Expenses Form FD4  Form FD4 , and attach receipts or other documents showing the costs of the expenses you are claiming. Spousal Support:

I want to change spousal support: If you are asking to change or end spousal support, whether you are the payor or recipient, you are required to file your Statement of Expenses Form FD6  Form FD6  and Statement of Income Form FD3  Form FD3  with all attachments. The attachments generally include:

  • Last 3 years’ Income Tax Returns and Notices of Assessment or Re-assessment from the Canada Revenue Agency; and

  • Current income information like:

    • If you are employed: your 2 most recent paystubs

    • If you are unemployed: your 2 most recent benefit statements (for example, from Employment Insurance, Workers’ compensation, medical Insurance, Income Assistance, CPP or other pension information)

    • If you are self-employed: your 3 most recent completed tax returns with attachments, including statement of business activities OR the 3 most recent financial statements of your business or professional practice.

NOTE: When applying to change spousal support - if you are married, have lived with your common law partner for 2 or more years, or are in a registered domestic partnership, your spouse/partner must also file their statement of income and statement of expenses

When you are filing a variation application, you must generally provide the court with the original and three copies of every document, or at least a copy for the court, a copy for you, and a copy for every other party.
